Fair Usage Policy for Fixed Fee Services

  1. Introduction
    This Fair Usage Policy ("Policy") sets out the terms and conditions governing the use of fixed fee services provided by Family Law Consultants ("the Firm") to its clients ("the Client"). The purpose of this Policy is to ensure that all Clients receive a consistent and high standard of service, and to prevent misuse or excessive use of the fixed fee arrangement.
  2. Scope of Fixed Fee Services
    1. The fixed fee covers only the specific services expressly set out in the engagement letter or service agreement between the Firm and the Client.
    2. Any services not expressly included within the scope of the fixed fee will be subject to additional charges, which will be notified to the Client in advance.
  3. Reasonable Use
    1. The fixed fee arrangement is intended to cover reasonable and proportionate use of the Firm's time and resources in relation to the agreed scope of work.
    2. Reasonable use includes:
      • Communications (telephone calls, emails, meetings) that are necessary and proportionate to the matter;
      • The number of drafts and revisions as specified in the engagement letter (or, if not specified, up to [two] drafts/revisions per document);
      • Attendance at meetings or hearings as specified in the engagement letter.
    3. Unreasonable or excessive use may include, but is not limited to:
      • Repeated or unnecessary requests for information or clarification;
      • Requests for work outside the agreed scope;
      • Excessive or lengthy communications beyond what is necessary for the matter;
      • Requests for additional drafts or revisions beyond those included in the fixed fee.
  4. Monitoring and Notification
    1. The Firm will monitor usage of the fixed fee services to ensure compliance with this Policy.
    2. If the Firm considers that the Client's use of the fixed fee services is or may become unreasonable or excessive, the Firm will notify the Client in writing, specifying the nature of the concern and the steps required to bring usage within reasonable limits.
    3. If, after notification, the Client's usage continues to exceed reasonable limits, the Firm reserves the right to:
      • Charge additional fees for further work, at the Firm's standard hourly rates; and/or
      • Terminate the fixed fee arrangement upon written notice.
  5. Amendments
    The Firm reserves the right to amend this Policy from time to time. Any amendments will be notified to the Client in writing and will take effect from the date of notification.
  6. Governing Law
    This Policy shall be governed by and construed in accordance with the laws of England and Wales.
