Parenting Plan Package

A Parenting Plan is a written agreement, worked out between parents after separation, setting out the practical issues/arrangements for parenting your children.

The Plan can help clarify the arrangements you need to put in place to care for your child/children after separation, without having to go to court. It will record the arrangements that you and your ex-partner have agreed and it asks parents to put the best interests of their children first when looking at such arrangements.

The court is the only body that can issue you with a legally binding and enforceable document (order) containing arrangements for your children. A parenting plan is a voluntary agreement. There are however many benefits of making a Parenting Plan:

  • it will help everyone involved know what is expected of them;
  • it acts as a valuable reference to go back to; and
  • it sets out practical decisions about the children, such as living arrangements, education and health care.

If you do go to court in the future, it is likely that judges will expect you to have started a Parenting Plan and there is an option to attach a copy of your agreement to the court application.

What's included within the package?
